2. Eligibility to Use Our Website

You must be legally capable of entering into a binding agreement to purchase products from our website.

By placing an order, you confirm that the information you provide to us is accurate, complete and current.

3. Products & Availability

We make reasonable efforts to ensure that product descriptions, fragrance information, images and other product details displayed on our website are accurate.

Product images are provided for illustrative purposes. Colours, appearance and presentation may vary depending on your device, screen or other factors.

Fragrance descriptions, notes, accords, fragrance families and other scent information are provided to help customers understand the character and profile of a fragrance. Individual experiences and perceptions of fragrances may vary.

Products are subject to availability. We reserve the right to limit quantities, discontinue products or make changes to products at any time.

If a product becomes unavailable after an order has been placed, we will contact you and, where appropriate, provide a refund for the unavailable product.

4. Legal Notice on Brand Use

All trademarks, brand names, logos, fragrance names and other intellectual property displayed on this website belong to their respective owners and are used for identification and informational purposes only.

Perfume Library is an independent retailer and is not affiliated with, endorsed by, sponsored by, or authorised by the fragrance brands or manufacturers whose products are displayed on our website, unless expressly stated otherwise.

Product names, brand names, logos, images and other identifying marks are used solely to accurately identify the products offered for sale. Our use of these names and marks does not imply any association, endorsement or partnership with the respective trademark owners.

5. Pricing & Payments

All prices displayed on our website are in Australian dollars (AUD) unless otherwise stated.

We reserve the right to change prices at any time. Changes to pricing will not affect orders that have already been accepted and confirmed.

Payment must be successfully received before an order can be processed and shipped.

We use third-party payment providers to process payments. We do not directly store your complete payment card details.

If an obvious pricing or listing error occurs on our website, we reserve the right to contact you regarding the error and, where appropriate, cancel the affected order and provide a refund.

6. Orders

When you place an order through our website, you are submitting a request to purchase the selected products.

After placing an order, you may receive an order confirmation acknowledging that we have received your order. This confirmation does not necessarily mean that your order has been accepted.

We reserve the right to cancel or decline an order in reasonable circumstances, including:

A product being unavailable.
An obvious pricing or listing error.
Suspected fraudulent or unauthorised activity.
We are unable to fulfil the order.

If we cancel an order after payment has been received, we will provide a refund for the amount paid for the cancelled order.

7. Shipping

Orders are shipped in accordance with our Shipping Information page.

Delivery timeframes provided on our website are estimates and may vary due to circumstances outside our reasonable control, including courier delays, public holidays, severe weather, technical issues and other unforeseen circumstances.

You are responsible for providing an accurate and complete delivery address when placing an order. Delays or additional costs resulting from incorrect or incomplete delivery information may be your responsibility, except where otherwise required by law.

8. Returns & Refunds

Our change-of-mind return policy allows eligible full-size fragrance bottles to be returned within 30 days of the delivery date, provided the bottle is completely unused and unopened, any original seals remain intact, the original packaging is included and the product is in resalable condition.

Perfume samples and decants are not eligible for change-of-mind returns or refunds.

Opened or used full-size fragrances are also not eligible for change-of-mind returns. We do not accept change-of-mind returns simply because a customer does not like the fragrance or has changed their mind.

For approved change-of-mind returns, the customer is responsible for the cost of returning the item.

These are our voluntary change-of-mind return conditions and do not limit, exclude or modify any rights or remedies available to you under the Australian Consumer Law.

If a product is faulty, damaged, defective, unsafe, incorrect, significantly different from its description, or otherwise does not meet an applicable consumer guarantee, your rights under the Australian Consumer Law may apply. This can include full-size fragrances as well as perfume samples and decants.

9. Intellectual Property

Perfume Library name, logo, website design, original text and other original materials created by or for Perfume Library are protected by applicable intellectual property laws.

Many product images, fragrance note images, main accord images, brand logos, trademarks, product names and other materials displayed on our website relate to third-party brands, manufacturers, suppliers or other sources. These materials remain the property of their respective owners or rights holders, unless otherwise stated.

Perfume Library does not claim ownership of third-party trademarks, brand names, logos, product images, fragrance note images, accord images or other third-party intellectual property displayed on our website.

Third-party materials are displayed for purposes such as identifying products, describing fragrances, providing information about brands and helping customers understand the products offered through our website.

If you believe that any material displayed on our website infringes your intellectual property rights, please contact us through our Contact Us page with details of the relevant material and your concerns. We will review the matter and take appropriate action where necessary.

10. Limitation of Liability

To the extent permitted by law, Perfume Library is not responsible for losses or damages arising from your use of our website where such liability can lawfully be excluded or limited.

We are not responsible for delays, interruptions or failures caused by circumstances outside our reasonable control, including courier delays, technical failures, internet disruptions, natural events or other unforeseen circumstances.

Nothing in these Terms & Conditions excludes, restricts or modifies any liability, guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under Australian law.

11. Australian Consumer Law

Nothing in these Terms & Conditions is intended to exclude, restrict or modify your rights under the Australian Consumer Law (ACL).

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

If a product does not meet an applicable consumer guarantee, you may have rights to a repair, replacement, refund or other remedy depending on the circumstances and the nature of the problem.

These statutory rights apply independently of our voluntary change-of-mind return policy.

Where there is any inconsistency between these Terms & Conditions and a non-excludable right or remedy under the Australian Consumer Law, the Australian Consumer Law will prevail to the extent of that inconsistency.

We may update these Terms & Conditions from time to time to reflect changes to our business, website, products or legal requirements.
